2. Service Estimates, Quotes, and Scope of Work

The Nature of Estimates: When our expert arborists visit your property to evaluate a tree, they are making professional judgments based on the visible exterior condition of the tree, the surrounding landscape architecture, and the anticipated difficulty of the removal or pruning process. The free estimate provided to you reflects our best professional calculation of the time, labor, and specialized equipment required to complete the requested scope of work safely and efficiently.
Unforeseen Complexities: It is crucial to understand that trees are living, dynamic organisms. In some instances, a tree that appears structurally sound from the outside may be suffering from extensive internal rot, profound decay, or severe structural compromise that is completely invisible to the naked eye. Similarly, once work commences, our crews may discover hidden hazards such as embedded metal (e.g., old nails, fencing, or wire engulfed by the trunk over decades), dangerous insect infestations, or unexpected root system entanglements.

For approved emergency structural removals, we offer flexible billing solutions. We do not require an upfront out-of-pocket payment before we begin stabilizing the scene. Instead, we coordinate directly with your homeowner's insurance company to process the claim and get our invoices paid through your coverage limits. By handling the complex paperwork and billing logistics, we allow you to focus entirely on the safety of your family and the restoration of your home.
4. Client Responsibilities: Property Access, Clearances, and Boundaries
To execute our highly technical services safely, we require an unobstructed working environment. As the Property Owner, you play a vital, active role in preparing the site for our arrival.
Clearing Vehicles and Debris: Before our trucks, wood chippers, and crew members arrive at your location, it is your strict responsibility to ensure that all driveways, access paths, and the immediate work zones are completely clear of obstacles. You must relocate all vehicles, motorcycles, boats, and trailers from the driveway and the street directly in front of the property. Additionally, you are required to clear the yard of all patio furniture, children's toys, grills, potted plants, lawn decorations, and any other movable personal property that sits within the drop zone or along the path we will use to haul brush and timber. If our crew arrives and is forced to spend significant time clearing your personal property to create a safe work zone, a site preparation fee may be added to your final invoice, or the job may need to be rescheduled.
Neighboring Properties and Boundary Lines: Trees rarely respect legal property lines. It is incredibly common for a tree whose trunk sits on your property to have heavy branches extending over your neighbor's roof, or conversely, for you to require pruning of a neighbor's tree that is encroaching on your airspace. Primo Tree Experts operates strictly within the bounds of the law, and we rely entirely on your accurate representation of property lines.
It is solely your responsibility, as the hiring Client, to definitively locate your property boundaries. If the execution of our services requires our crew to cross property lines, stand on a neighbor's lawn, or physically drop branches into a neighboring yard for processing, you are legally required to obtain explicit, written permission from that neighboring property owner prior to our arrival. Primo Tree Experts assumes no responsibility for property line disputes, boundary disagreements, or trespassing claims arising from your failure to secure the necessary authorizations. By signing our estimate or allowing work to commence, you are legally guaranteeing to us that you have the right to authorize the work on all affected trees and have secured all necessary neighborly consents.
5. Underground Utilities and Hidden Hazards
The surface of your lawn is only half of the landscape; beneath the soil lies a complex, invisible network of utilities and systems. When we bring heavy equipment onto your property or engage in stump grinding, the integrity of these subterranean systems becomes a critical concern.
Public Utilities: In accordance with state law, Primo Tree Experts will contact the appropriate local authorities (such as Gopher State One Call) to mark public underground utility lines (e.g., municipal water mains, main sewer lines, public gas lines, and main electrical grids) prior to commencing significant subterranean work like deep stump grinding.
Private Utilities (Client Responsibility): Public utility companies do not and will not map or mark privately installed underground systems. Therefore, it is your absolute and non-negotiable responsibility to clearly identify and physically mark the location of all private underground installations. This includes, but is not limited to:
Improving Website Functionality and Services: While we do not use automated analytics to track your behavior on our Website, we do listen to direct feedback. If you communicate with us regarding your experience using our site or booking our services, we use that qualitative feedback to make our Website more user-friendly and to refine our operational procedures. This is a direct, human-to-human improvement process, completely devoid of algorithmic tracking.

Waiver of Liability for Unmarked Lines: Because our crews cannot see through the dirt, Primo Tree Experts is entirely exempt from any and all liability for damages caused to unmarked, poorly marked, or incorrectly identified private underground utilities. If we are grinding a stump and our machine severs an invisible dog fence or shatters a sprinkler pipe that you did not explicitly mark and bring to our foreman's attention before work began, the financial cost of repairing those systems falls entirely on you.
6. Heavy Equipment and Minor Landscape Impact
Professional tree removal is an intense, heavy-duty industrial process that takes place in the delicate environment of your residential backyard. We utilize massive pieces of machinery, including bucket trucks, articulated loaders, skid steers, massive wood chippers, and occasionally heavy-duty cranes.
Lawn and Driveway Impact: While our highly trained crews take meticulous, exhaustive precautions to protect your landscape—such as laying down protective ground mats where feasible and navigating equipment with surgical precision—the sheer weight of this machinery combined with the massive tonnage of the wood being removed means that a completely zero-impact job is physically impossible.
Clients must anticipate and accept that minor, superficial damage to the landscape is a natural byproduct of professional tree care. This includes minor lawn rutting, compacted soil, scuffed grass, small divots caused by falling branches, or tire marks on concrete and asphalt driveways.
Primo Tree Experts is committed to leaving your property clean, removing all debris generated by our work, and raking the work zone. However, we are not liable for the cost of re-seeding lawns, fixing minor ruts, power-washing tire marks off driveways, or repairing superficial landscape scuffs. By hiring us, you acknowledge that the safe removal of a multi-ton tree takes absolute precedence over the pristine condition of the grass beneath it. (Note: This exemption does not apply to severe negligence resulting in major structural damage to your home, which is fully covered by our comprehensive commercial liability insurance).
7. Financial Agreements, Billing, and Standard Payment Terms
Beyond emergency insurance situations (detailed in Section 3), we strive to make our billing process as straight forward and transparent as possible for routine tree care, pruning, and standard removals.
Payment Due Upon Completion: For all standard, non-emergency residential and commercial services, full payment is due immediately upon the completion of the work. Once our crew has finished the agreed-upon scope of work, processed the debris, and conducted a final walk-through or site cleanup, our office will issue a finalized invoice.
Accepted Methods of Payment: To provide maximum convenience, Primo Tree Experts accepts a variety of payment methods, including major credit cards, debit cards, standard bank checks, and cash. Any specific digital payment gateways or mobile payment systems utilized by our crews will be detailed on your official invoice.
Late Fees and Collection Costs: We are a locally owned business that relies on timely payments to pay our hardworking crews, maintain our heavy equipment, and keep our operations running smoothly. If an invoice remains unpaid for an extended period beyond the completion date without a prior written payment arrangement, Primo Tree Experts reserves the absolute right to assess compounding late fees.
Furthermore, if a client persistently refuses to pay for services rendered, you agree that you will be held legally responsible for all costs associated with the collection of the debt. This includes, but is not limited to, third-party collection agency fees, attorney fees, court costs, and filing fees.
8. Scheduling, Weather Delays, and Cancellations
Tree care is an outdoor profession that is entirely at the mercy of the often unpredictable Minnesota weather.
Weather-Related Delays: The safety of our crews and the protection of your property are our highest priorities. Operating chainsaws in bucket trucks during high winds, lightning storms, torrential downpours, or severe ice conditions is incredibly dangerous. Therefore, Primo Tree Experts reserves the right to postpone, reschedule, or temporarily halt any scheduled service at our sole discretion if our management or on-site foremen determine that weather conditions pose an unacceptable safety risk. We will communicate with you promptly to reschedule the work for the next available safe date, but we are not liable for any inconvenience or indirect costs caused by these weather-mandated delays.
Client Cancellations: If you need to cancel or reschedule a booked service for personal reasons, we ask that you respect our schedule and the time of our crews. We require a reasonable notice period—typically 24 to 48 hours—so that we can adjust our dispatch logs and offer your time slot to another client in need. While we strive to be flexible and understanding of life's unexpected events, repeated last-minute cancellations or turning our crews away at the door after they have already driven heavy equipment to your property may result in a cancellation fee to cover our lost labor and fuel costs.
9. Limitation of Liability and Indemnification
To the fullest extent permitted by the applicable laws of the State of Minnesota, Primo Tree Experts, its owners, employees, contractors, and affiliates shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total, aggregate liability for any direct damages arising from our negligence or failure to perform the agreed-upon services shall be strictly limited to the total amount you actually paid to Primo Tree Experts for the specific services that caused the alleged damage.
10. Governing Law, Jurisdiction, and Dispute Resolution
Because Primo Tree Experts is deeply rooted in the local community, all aspects of our business operations, contracts, and these Terms and Conditions are governed exclusively by the laws of the State of Minnesota, without regard to its conflict of law principles.
In the unlikely event that a dispute, disagreement, or claim arises out of our services or this agreement, both you and Primo Tree Experts agree to attempt to resolve the matter amicably through direct, good-faith negotiation.
